Milkshake Denied: Roswell Man’s Disturbing Threats Stir Police Response
In a bizarre turn of events, New Mexico law enforcement reported an incident involving an allegedly ‘impaired’ Roswell resident who threatened Arby’s employees with a potential shooting after they refused to serve him a free milkshake. Tommy Smith, aged 56, has since pleaded not guilty to the charges stemming from this unsettling episode that took place in April.
According to the fast-food employees, Smith seemed to be in a disoriented mental state as he entered the Arby’s located at the 1300 block of North Main Street with an unusual demand.
“He told the workers that he would shoot them with the gun he had in his backpack.”
When asked if he was prepared to pay for his milkshake, Smith insisted he wanted it for free. Upon being denied, Smith’s reaction was alarming – he clenched his fists and disappeared into the restroom.
Emerging from the restroom, Smith once again addressed the employees, threatening to shoot them with a gun he claimed was in his backpack if they didn’t fulfill his request. The employees, faced with this threat, reported the unsettling man to the police.
Upon arrival, the police found Smith seated at a table, displaying signs of impairment, such as slurred speech and instability. However, when they conducted a search, they found no firearm in his backpack.
Following this, the police arrested Smith on charges including attempted robbery, disorderly conduct, and public nuisance. He was later taken to the Chaves County Detention Center. Chaves County Magistrate Court Judge K. C. Rogers set Smith’s bond at $2,500.
Roswell, the city where these events unfolded, is a small southeastern New Mexico city with approximately 47,000 inhabitants. The city is widely known for its popularity among UFO conspiracy theorists, who believe an extraterrestrial vehicle crashed there in 1947.

Yes, always – businesses should always have the right to refuse service for safety reasons.

Impairment had nothing to do with it. He did not want to pay.

Any business should have the right to refuse service to any individual, according to the rules of that business.
